Standard Terms and Conditions of
Temporary Holiday Accommodation
Note: The
Terms & Conditions of the holiday letting is agreed by both parties.
Departure from the same by the Renter permits the Agent or Owner to
refuse entry, amend the rent or immediately terminate the occupancy.
Variances can be agreed on, but only by arrangement with the
agent/owner in writing prior to day of arrival.
Non refundable deposit of 20% of the total rental amount is
required to secure the booking. Payment of the rental deposit
constitutes the clients acceptance of these Terms and Conditions.
Balance of the rental amount must be paid in full 30 days
prior to occupancy. If the balance of the total rental amount has
not been received by the owner at the due time, the owner has the
right to cancel the booking and re-let the property. Booking made
within two (2) months of arrival require full payment on booking.
Cancellation if caused by the client, money paid is not
refundable.
Security Deposits: A security deposit or credit card number
is to be left as security. It is designed to cover any additional
costs incurred including but not limited to, any breakage, damage or
excess cleaning requirements, missing property, extra guests beyond
those declared, late checkout, excess garbage removal. In most cases
a Security Deposit will be required. The charging of a
Security Deposit is at the sole discretion of the Booking
Agent/Owner at the time of booking. The Renter agrees for the
agent/owner to deduct such extra charges from their credit card or
security deposit. The person making the booking must stay in the
property and will be responsible for the conduct of all guests.
Extra Charges: see list in home. Deductions from the tenant’s
credit card or Security deposit will be made if the Agent/Owner need
to make a claim which may include, but not limited to, the
following: excess cleaning, damage or breakages, excess garbage
removal, late check out, lost keys, Security Guard call out for loud
noise, missing property, extra guests.
The property owners will make every effort to ensure the
property is available as booked. However the owners reserve the
right to make alterations to bookings due to unforeseen
circumstances. The tenant agrees to give access to trades people,
gardeners, pool service technicians and any other trades person
that maybe required for repairs, maintenance, damage and
improvements the owner/agent deems necessary.
To maintain a good standard for our guests we require certain
conditions to be complied with. The premises are to be left in a
clean and tidy condition. Please ensure dishes, pots and pans etc
are washed and put back into cupboards. We appreciate most will
respect our property but the occasional abuse requires that we state
the following conditions:
1. Number of Guests should not exceed the number stated on
the Confirmation Notice or subsequently agreed in writing or email.
Fees will apply for excess guests not agreed with the owners in
advance.
2. Parties, Functions, loud noise and excessive drinking are
all strictly prohibited. The rent charged is for domestic use only
and not commercial. Accordingly this rate does not allow for the
extra wear associated with functions in terms of cleaning, garbage
removal, wear and tear, repairs etc. Use contrary to this may result
in loss of your Security deposit and/or additional payments.
3. Damage, Breakages, Theft and Loss are the tenants
responsibility during their stay.
4. Departure - the property should be left in a similar state
to its condition on arrival, otherwise extra charges will apply.
5. Check-out time is 10am, to allow time to prepare property
for next guests. Check-in time is 2pm on day of arrival.
6. Disturbance to our neighbours, including excessive noise
at any time, is prohibited and may result in termination of rental
and loss of Security deposit. Strata Title Law must be observed.
Please note you are in a residential area and regard must be paid to
the quiet enjoyment of neighbouring properties. If a Security Guard
is called out following a noise complaint, to the agent or police by
neighbours, a $100 call out fee will be payable by the tenant.
Second complaint will cause eviction with no refund.
Linen is to be supplied by the tenant unless arranged when
booking.
Pets are not allowed unless specific arrangements have been
made in writing with the owner.
Smoking is not allowed in the house.
Loss - the owners take no responsibility for the tenant's
personal property.
Pool conduct – no glasses or glass products are allowed in
the pool area. Use of pool is restricted to between 8am and 9pm
daily. This helps to keep noise levels down when people are
sleeping. It is also courtesy to our neighbours.
Website content - Vision on the website is an accurate
representation of the property, but the agent/owner is not
responsible for personal perceptions. Vision on the website is based
on professional photographs using accessories that may or may not be
present on arrival. e.g. bottle of Dom Perignon champagne. No
provision can or will be made for relocation if property is deemed
unsatisfactory on arrival other than on the basis that the full
rental due be forfeited and full rental on the new premises is paid
prior to occupancy.
In the unlikely event the property is offered for sale, the tenant
agrees to allow the agent/owner to inspect the property with
prospective purchasers during reasonable hours by appointment. The
agent/owner cannot be held responsible should a property be sold and
the booking cancelled. All endeavours to find alternative
accommodation will be made by the agent/owner.
